Clinton Man Charged with Burglary, Firearm Possession, and DUI After Alleged Home Invasion

Clinton, OK – A Clinton man is facing multiple felony and misdemeanor charges after allegedly breaking into a home, assaulting a resident, and later being found driving under the influence with a firearm and drugs in his vehicle.

According to a probable cause affidavit filed in Custer County District Court, Robert Venegas Rios, 35, of Clinton, was charged with first-degree burglary, possession of a firearm after a felony conviction, assault and battery, driving under the influence, possession of marijuana, and driving with a suspended license. The charges stem from an incident that occurred on October 25, 2025.

Prosecutors allege that Rios forcibly entered a home in the 1600 block of Prairie Chief Avenue in Clinton. The affidavit states Rios broke through the door and entered the residence without consent, allegedly attacking the homeowner by striking him several times in the head. Police were later called to the scene.

Officers with the Clinton Police Department later located Rios driving a 2019 white Hyundai in the 400 block of North 14th Street. Reports indicate he was under the influence of alcohol at the time. Inside the vehicle, police said they found a Mossberg Maverick Model 88 shotgun and a small amount of marijuana. Records show Rios’ driver’s license was suspended.

Court documents show Rios has multiple prior felony convictions in Custer County, including distribution of controlled substances near a park or school and second-degree burglary. Because of those prior convictions, prosecutors have filed an enhancement alleging he is an after former conviction of two or more felonies, which increases potential penalties.

If convicted, Rios faces 7 to 20 years for the burglary charge and up to life in prison under the enhancement. The firearm charge carries 1 to 10 years, while the misdemeanors carry additional potential jail time and fines.

Rios was booked into the Custer County Jail and is expected to appear in court for arraignment.
