California Man Charged With Marijuana Trafficking After I-40 Traffic Stop

Custer County, OK – A California man is facing a felony drug trafficking charge after authorities say nearly 100 pounds of marijuana were discovered during a traffic stop in Custer County.

According to a probable cause affidavit filed in Custer County District Court, Andrei Miguel Hickman Diago, 40, is charged with trafficking in illegal drugs, specifically marijuana, after allegedly transporting more than 25 pounds of the substance through Oklahoma.

Court documents state the investigation began the evening of Feb. 7, when a Texas trooper stopped a white 2025 GMC Denali traveling eastbound from Shamrock, Texas. During that stop, Diago reportedly told the trooper he was traveling from Las Vegas to Tennessee and was transporting his mother’s dog because it was afraid to fly. The trooper noted Diago appeared nervous and provided inconsistent statements about his travel plans. A K-9 unit did not alert during the Texas stop, and Diago was released with a warning.

Shortly afterward, an Oklahoma deputy on Interstate 40 near the 65-mile marker in Custer County observed the same vehicle traveling 67 miles per hour in a 50 mile per hour construction zone. The deputy initiated a traffic stop. The affidavit states the vehicle did not immediately pull over and continued for approximately one mile before stopping.

During questioning, Diago reportedly gave a different account of his travel, stating he had been staying with a friend in Amarillo, Texas, for a couple of days and was now heading home with his mother’s dog. Authorities noted the statements conflicted with the information provided during the earlier Texas stop. Investigators also reported Diago claimed the vehicle had already been searched in Texas, which they later confirmed was not accurate.

A K-9 unit from a neighboring county responded to the scene and conducted a free air sniff around the vehicle. The dog alerted to the odor of narcotics, according to the affidavit.

A subsequent search of the vehicle allegedly revealed five large cardboard boxes in the trunk, covered by a blanket. Inside the boxes, officers reported finding 100 vacuum sealed packages containing a green leafy substance believed to be marijuana. Authorities stated the packages weighed approximately one pound each, totaling an estimated 100 pounds.

Two randomly selected packages were field tested and reportedly tested positive for THC. The marijuana was seized and secured as evidence. A small dog found in the vehicle was taken into custody by animal control.

Diago was arrested and booked into the Custer County Jail.

Under Oklahoma law, trafficking in marijuana in amounts exceeding 25 pounds is punishable by up to 20 years in prison and a fine ranging from $25,000 to $100,000.

The case remains pending in Custer County District Court.
